Requirements for Trademark Registration in Thailand

Registering your trademark provides legal protection against infringement or counterfeiting of your intellectual property and distinguishes your goods or services from those of your competitors. It also guarantees that you are not infringing on a trademark belonging to another business. In Thailand, trademark protection is governed by the Trademark Act. Although Thai law does not require it, trademark registration in Thailand is the only way to protect and enforce your Trademark rights.

Foreign Trademarks

Although Thai law recognizes foreign trademarks, it only provides limited protection since Thailand is not closely bound by international treaties or conventions that provide such protection. As such, foreign business owners doing business in Thailand are advised to register their trademarks with the relevant Thai authority to guarantee their trademark rights. Fortunately, trademark protection becomes effective on the day your application is submitted, regardless of the duration of the entire trademark registration process.

Criteria for Registration

Lawful trademark registration in Thailand is only possible when the trademark is distinctive so consumers can differentiate your goods from others. In addition, the trademark must not be prohibited under the Trademark Act, and it must not be similar to a mark that is already registered. Generally, a trademark could include objects, paintings, photographs, numerals, letters, signatures or colors.

Business Address

As part of the requirements for trademark registration, the applicant must have a fixed business address in Thailand. Foreigners residing outside Thailand but intending to register their trademarks should therefore appoint an agent that resides in Thailand. The agent is granted power of attorney and can then register the trademark on behalf of the foreigner. Note that trademark applications must be filled out in Thai, so it is important to work with a professional.

Trademark Registrar

Prior to trademark registration in Thailand, it would be helpful to perform a trademark search to avoid possible complications from similar trademarks. The trademark registrar will determine whether the mark is acceptable. The trademark registrar may also seek explanations concerning your trademark. Failure to comply with any request for additional information may result in failure to register the trademark. If no problems arise, the trademark application is published in the Trademark Journal and a registration certificate is issued 90 days following the publication if no objections are raised. The certification process takes about six months to one year from the date of filing.


In some cases, the Registrar may propose amendments to the application, giving the applicant 90 days to make such amendments. If you disagree with the proposed amendments or if your registration application is denied, you have 90 days to file an appeal with the Board of Trademark committee. The result of the appeal will be final.


A registered trademark is valid for 10 years from the date the Trademark application is filed. In order to renew your trademark registration in Thailand, you will need to file an application within 90 days prior to the expiration day of your trademark. The Trademark Office is not required to give notice to the trademark owner, so ensure that you are aware of your expiration date to avoid compromising your trademark rights in the future.
